利用規約
この利用規約（以下、「本規約」といいます）は、TXT sampler（以下、「本アプリ」といいます）の利用条件を定めるものです。ユーザーは、本規約に同意したうえで本アプリを利用するものとします。
1. 適用
本規約は、本アプリの利用に関するユーザーと開発者とのすべての関係に適用されます。
2. 本アプリの内容
本アプリは、録音または読み込んだ音声サンプルをパッドに割り当て、シーケンスやプロジェクトとして管理し、対応する外部MIDI機器から演奏・編集操作を行えるiOS向けサンプラーアプリです。
3. ユーザーの責任
ユーザーは、本アプリに読み込む音声、録音する音声、作成するプロジェクトおよび書き出した音源について、必要な権利または許諾を自身の責任で確認するものとします。第三者の著作権、著作隣接権、その他の権利を侵害しないよう注意してください。
ユーザーが本アプリを使用して作成、保存、共有、公開、配布、販売する音源その他の制作物については、ユーザー自身が一切の責任を負うものとします。
4. 禁止事項
- 法令または公序良俗に反する行為
- 第三者の権利を侵害する音声データの利用
- 著作権、著作隣接権、肖像権、その他第三者の権利を侵害するサンプルまたは音源の作成、共有、公開、配布、販売
- 公序良俗に反するサンプルまたは音源の作成、共有、公開、配布、販売
- 本アプリの解析、改変、再配布、または不正利用
- 本アプリの運営または他のユーザーに不利益を与える行為
5. 課金（プレミアムプラン）について
本アプリは無料でご利用いただけますが、一部機能に制限があります。「プレミアムプラン（買い切り）」をご購入いただくことで、すべての機能を利用できるようになります。
- プレミアムプランの決済は、Appleが提供する決済システム（StoreKit）を通じて行われます。
- 購入したプレミアムプランの復元は、アプリ内の「設定 > About > 購入を復元」から行うことができます。
- 本アプリのご利用には、本規約のほか、Appleが提供する標準使用許諾契約（EULA）が適用されます。
6. データ管理
本アプリのデータは主に端末内に保存されます。端末の故障、削除、OSの不具合、アプリの削除などによりデータが失われる可能性があります。重要なデータはユーザー自身の責任で管理してください。
7. 免責事項
本アプリは現状のまま提供されます。開発者は、本アプリが常に正常に動作すること、すべての端末、iOSのバージョン、音声機器または外部MIDI機器と互換性があること、ならびに中断、遅延、信号欠落、誤入力またはデータ消失が発生しないことを保証しません。
ユーザーが著作権、著作隣接権、肖像権、その他第三者の権利を侵害するサンプルを使用した場合、または公序良俗に反するサンプルを使用して音源その他の制作物を作成、共有、公開、配布、販売した場合に生じるトラブル、請求、紛争または損害について、開発者は責任を負いません。
外部MIDI機器、ケーブル、変換アダプタ、USBハブ、電源、ファームウェア、iOS、通信環境または各メーカーの仕様に起因する接続不良、動作不良、遅延、信号欠落、誤入力、データ消失その他の損害について、開発者は責任を負いません。ユーザーは、音量を適切に管理し、ライブ演奏その他の重要な用途では事前に動作を確認するものとします。
Apple、通信事業者その他の第三者が提供するサービスの停止もしくは仕様変更、天災、停電、通信障害その他開発者が合理的に管理できない事由により生じた損害について、開発者は責任を負いません。
開発者の軽過失によってユーザーに損害が生じた場合、開発者が負う責任は、通常かつ直接の損害に限ります。この制限は、開発者に故意または重大な過失がある場合には適用されません。
外部MIDI機器自体の仕様、設定方法、接続方法、個別機器との互換性または動作確認に関するお問い合わせには対応していません。ただし、本アプリに起因すると考えられる不具合の報告は受け付けます。サポートフォームへの個別回答、修正、要望の採用または対応期限を保証するものではありません。
8. 仕様変更・提供停止
開発者は、運営上または技術上の理由により、本アプリの仕様、機能、配信、アップデート、サポートまたは一部機能を、予告なく変更、中断もしくは終了することがあります。緊急またはやむを得ない場合を除き、可能な範囲で事前に案内します。
配信、アップデートまたはサポートの終了後も、利用環境が対応している限りインストール済みの本アプリを利用できる場合がありますが、将来のiOS、端末、Appleのサービスまたは外部機器での継続動作、再ダウンロードもしくは購入復元を保証するものではありません。
9. 規約の変更
開発者は、必要に応じて本規約を変更できるものとします。変更後の規約は、このページに掲載された時点で効力を生じます。

本規約は日本法に準拠します。

These Terms of Use (the "Terms") set forth the conditions for using TXT sampler (the "App"). Users shall use the App after agreeing to these Terms.
1. Scope
These Terms apply to all relationships between users and the developer regarding use of the App.
2. Description of the App
The App is an iOS sampler app that assigns recorded or imported audio samples to pads, manages them as sequences and projects, and supports performance and editing controls from compatible external MIDI devices.
3. User Responsibility
Users are responsible for confirming that they have the necessary rights or permissions for audio imported into the App, audio recorded with the App, projects created with the App, and exported audio. Users must take care not to infringe copyrights, neighboring rights, or other third-party rights.
Users are solely responsible for audio and other works that they create, save, share, publish, distribute, or sell using the App.
4. Prohibited Acts
- Acts that violate laws or public order and morals
- Use of audio data that infringes third-party rights
- Creation, sharing, publication, distribution, or sale of samples or audio that infringes copyrights, neighboring rights, portrait rights, or other third-party rights
- Creation, sharing, publication, distribution, or sale of samples or audio that violates public order and morals
- Analysis, modification, redistribution, or unauthorized use of the App
- Acts that disadvantage the operation of the App or other users
5. Purchases (Premium Plan)
The App can be used for free, but some features are limited. By purchasing the "Premium Plan (one-time purchase)," users can use all features.
- Payment for the Premium Plan is processed through Apple's payment system (StoreKit).
- The purchased Premium Plan can be restored from "Settings > About > Restore Purchases" in the App.
- Use of the App is subject to these Terms and Apple's Standard End User License Agreement (EULA).
6. Data Management
App data is mainly stored on the device. Data may be lost due to device failure, deletion, OS issues, app deletion, or similar causes. Users are responsible for managing important data.
7. Disclaimer
The App is provided as is. The developer does not warrant that the App will always operate normally, that it will be compatible with every device, iOS version, audio device, or external MIDI device, or that it will be free from interruptions, latency, dropped signals, unintended input, or data loss.
The developer is not responsible for troubles, claims, disputes, or damages that arise if a user uses samples that infringe copyrights, neighboring rights, portrait rights, or other third-party rights, or uses samples that violate public order and morals to create, share, publish, distribute, or sell audio or other works.
The developer is not responsible for connection failures, malfunctions, latency, dropped signals, unintended input, data loss, or other damages caused by external MIDI devices, cables, adapters, USB hubs, power supplies, firmware, iOS, communication environments, or manufacturer specifications. Users must manage volume appropriately and verify operation in advance for live performance or other important uses.
The developer is not responsible for damages caused by suspension or changes to services provided by Apple, telecommunications carriers, or other third parties, natural disasters, power outages, communication failures, or other events beyond the developer's reasonable control.
If a user suffers damage due to the developer's ordinary negligence, the developer's liability is limited to ordinary and direct damages. This limitation does not apply in cases of the developer's intent or gross negligence.
The developer does not provide support for the specifications, configuration, connection methods, compatibility, or operation of individual external MIDI devices. Reports of issues believed to be caused by the App are accepted. The developer does not guarantee an individual reply, a fix, adoption of a request, or a response deadline for support-form submissions.
8. Changes to Specifications and Suspension of Service
For operational or technical reasons, the developer may change, suspend, or discontinue the App's specifications, features, distribution, updates, support, or certain functions without prior notice. Except in emergencies or unavoidable circumstances, advance notice will be provided where reasonably practicable.
After distribution, updates, or support ends, an installed copy of the App may remain usable while the user's environment remains compatible. However, continued operation with future versions of iOS, devices, Apple services, or external hardware, as well as future re-downloads or purchase restoration, is not guaranteed.
9. Changes to These Terms
The developer may change these Terms as necessary. The revised Terms take effect when posted on this page.
10. Governing Law
These Terms are governed by the laws of Japan.
